Appendix F: Assessment of Site Allocation Policies

F.1 Overview

F.1.1 Introduction

F.1.1.1 This appendix provides an assessment of 27 draft site-specific policies prepared by Maidstone Borough Council (MBC) presented in the Regulation 18c 'Preferred Policies and Potential Sites' consultation for the emerging Gypsy, Traveller and Travelling Showpeople (GTTS) Development Plan Document (DPD), setting out MBC's preferred sites for allocation and their site-specific requirements.

F.1.1.2 The DPD also contains a range of strategic and development management (DM) policies to guide the proposed development, which have been assessed in Appendix D.

F.1.1.3 Each site allocation policy appraised in this appendix has been assessed for its likely impacts on each SA Objective of the SA Framework (see Appendix A) in accordance with the methodology as set out in Chapter 2 of the main report (see Volume 1).

F.1.1.4 The site allocation policies relate to proposed development sites which have also been assessed as part of the reasonable alternative sites in the SA process, based on the site assessment methodology as presented in Appendix B. The assessment of site policies has drawn on the findings from the post-mitigation evaluation of reasonable alternative sites (see Appendix E), but also takes into account the further site-specific information and mitigation proposed through the site policies for the allocated sites.

F.1.1.5 For ease of reference the scoring system is summarised in Table F.1.1.

F.1.1.6 Each appraisal in the following sections of this report includes an SA impact matrix that provides an indication of the nature and magnitude of effects. All impact matrices are accompanied by an assessment narrative which describes the findings of the appraisal and provides a rationale for the recorded impact values.

F.1.1.7 Within these policy assessments, where relevant, some recommendations for enhancement of the site allocation policies have been suggested (see Table F.3.2). These recommendations, alongside more general recommendations for the DPD going forward, are also summarised in Chapter 8 of the main SA Report (Volume 1).

F.2 Site allocation policies

F.2.1 Policy GT(LPR1) – The Kays, Heath Road, Linton

F.2.1.1 Policy GT(LPR1) sets out details for the allocation of Site 0057 as assessed in the SA process. The full assessment of the site, alongside other reasonable alternatives, can be found in Appendix C (pre-mitigation) and Appendix E (post-mitigation).

F.2.1.2 The following assessment considers the extent to which the provisions of Policy GT(LPR1) will further improve sustainability of the site.

Policy GT(LPR1) – The Kays, Heath Road, Linton

In accordance with policy TR4 planning permission for two permanent pitches at The Kays, Heath Road, Linton, as shown on the Policies Map, will be granted if the following criteria are met:

  1. The total capacity of the site does not exceed three gypsy and traveller pitches.
     
  2. Access to the site is via the existing access off Heath Road.
     
  3. The additional pitches are located towards the rear of the site and not forward of the existing mobile home.

F.2.1.3 Policy GT(LPR1) sets out the requirements for the location of pitches within the site, and access to the site. The policy will be likely to ensure that the GTTS development is of an appropriate scale to its surroundings and that safe access is provided. These provisions are, however, unlikely to further enhance the site's sustainability performance beyond what was identified in the post-mitigation assessment. Accordingly, the assessment of the policy against the SA Objectives remains unchanged from that presented for Site 0057 in Appendix E.

F.2.2 Policy GT(LPR2) – Greenacres (Plot 5), Church Lane, Boughton Monchelsea

F.2.2.1 Policy GT(LPR2) sets out details for the allocation of Site 0168 as assessed in the SA process. The full assessment of the site, alongside other reasonable alternatives, can be found in Appendix C (pre-mitigation) and Appendix E (post-mitigation).

F.2.2.2 The following assessment considers the extent to which the provisions of Policy GT(LPR2) will further improve sustainability of the site.

Policy GT(LPR2) – Greenacres (Plot 5), Church Lane, Boughton Monchelsea

In accordance with policy TR4, planning permission for two permanent pitches at Greenacres (Plot 5), Church Lane, Boughton Monchelsea, as shown on the Policies Map, will be granted if the following criteria are met:

  1. The total capacity of the site does not exceed three gypsy and traveller pitches.
     
  2. Access to the site is via the existing access off Church Hill.
     
  3. The additional pitch is sited on the existing hardstanding and not beyond the site boundaries defined on the Policies Map.
     
  4. A landscaping scheme for the site is approved which provides for:
     
    1. The retention and future maintenance of the trees and hedge line along the site frontage to Church Hill; and
       
    2. The establishment of a landscaped boundary to the south of the site comprising native species to provide an effective screen to the development.

F.2.2.3 Policy GT(LPR2) sets out the requirements for the location of pitches within the site. By ensuring the additional pitch is situated on the existing hardstanding on-site, any loss of previously undeveloped land is likely to be avoided. Therefore, a negligible impact on natural resources (SA Objective 6) is identified.

F.2.2.4 The policy requires trees and hedges along the site's frontage to be maintained, and a new landscaped boundary to the south. This will be likely to help to minimise intrusion on the landscape, and potentially enhance the character and appearance of the site and its surroundings. A minor positive impact on the landscape (SA Objective 13) is identified.

F.2.2.5 For the remaining SA Objectives, the policy's provisions are unlikely to further enhance the site's sustainability performance beyond what was identified in the post-mitigation assessment. Accordingly, the assessment of the policy against the other SA Objectives remains unchanged from that presented for Site 0168 in Appendix E.

F.2.3 Policy GT (LPR3) – Land at Blossom Lodge, Stockett Lane, Coxheath

F.2.3.1 Policy GT(LPR3) sets out details for the allocation of Site 0018 as assessed in the SA process. The full assessment of the site, alongside other reasonable alternatives, can be found in Appendix C (pre-mitigation) and Appendix E (post-mitigation).

F.2.3.2 The following assessment considers the extent to which the provisions of Policy GT(LPR3) will further improve sustainability of the site.

Policy GT(LPR3) – Land at Blossom Lodge, Stockett Lane, Coxheath

In accordance with policy TR4, planning permission for two permanent pitches at Land at Blossom Lodge, Stockett Lane, Coxheath, as shown on the Policies Map, will be granted if the following criteria are met:

  1. The total capacity of the site does not exceed six gypsy and traveller pitches.
     
  2. Access to the site is via the existing access off Stockett Lane.
     
  3. The additional pitches are sited on the existing hardstanding and not beyond the site boundaries defined on the Policies Map.
     
  4. A landscaping scheme for the site is approved which provides for the retention and future maintenance of the hedgerows and tree planting along the site’s northern, southern, western and eastern boundaries and the native hedgerow bordering the public footpath which crosses the site.

F.2.3.3 Policy GT(LPR3) sets out the requirements for the location of pitches within the site. There is potential for a minor positive impact on the landscape (SA Objective 13).

F.2.3.5 For the remaining SA Objectives, the policy's provisions are unlikely to further enhance the site's sustainability performance beyond what was identified in the post-mitigation assessment. Accordingly, the assessment of the policy against the other SA Objectives remains unchanged from that presented for Site 0018 in Appendix E.

F.2.3.6 See Table  F.3.2 for recommendations regarding the residual adverse or uncertain effects identified.

F.2.4 Policy GT(LPR5) – Kilnwood Farm, Old Ham Lane, Lenham

F.2.4.1 Policy GT(LPR5) sets out details for the allocation of Site LPRGT1(5) as assessed in the SA process. The full assessment of the site, alongside other reasonable alternatives, can be found in Appendix C (pre-mitigation) and Appendix E (post-mitigation).

F.2.4.2 The following assessment considers the extent to which the provisions of Policy GT(LPR5) will further improve sustainability of the site.

Policy GT(LPR5) – Kilnwood Farm, Old Ham Lane, Lenham

In accordance with policy TR4, planning permission for two permanent pitches at Kilnwood Farm, Old Ham Lane, Lenham, as shown on the Policies Map, will be granted if the following criteria are met:

  1. The total capacity of the site does not exceed four gypsy and traveller pitches.
     
  2. Access to the site is via the existing access off Old Ham Lane.
     
  3. A landscaping scheme for the site is approved which provides for the retention and future maintenance of the trees and woodland along the northern, western and eastern boundaries of the site to secure the effective screening of the site.
     
  4. The siting of the additional mobile homes maintains a 15m buffer to the Ancient Woodland.
     
  5. An ecological assessment of the site is undertaken and an ecological enhancement and wildlife management plan for the site is approved.

F.2.4.3 Policy GT(LPR5) sets out the requirements for a landscaping scheme and wildlife management plan that ensures trees and woodland alongside the site boundaries are maintained and ecological enhancements are secured. Furthermore, a 15m buffer between mobile homes and ancient woodland is required, affording additional protection to the nearby Kiln Wood and the wider 'Kiln Wood and Oxley Wood, Lenham' Local Wildlife Site (LWS). Despite these measures, in absence of the HRA conclusions the overall impact for SA Objective 11 remains uncertain owing to potential for development at this site to contribute to cumulative adverse effects associated with air quality, water quality/quantity and recreation at European sites.

F.2.4.4 The proposed landscaping scheme and maintenance of trees and woodland will be likely to help minimise intrusion on the landscape and reduce potential for harm to the character and appearance of the site and its surroundings, although specific protection is only afforded through the policy to trees along the site boundaries rather than elsewhere on- site. Overall, a negligible impact on the landscape (SA Objective 13) is identified.

F.2.4.5 For the remaining SA Objectives, the policy's provisions are unlikely to further enhance the site's sustainability performance beyond what was identified in the post-mitigation assessment. Accordingly, the assessment of the policy against the other SA Objectives remains unchanged from that presented for Site LPRGT1(5) in Appendix E.

F.2.4.6 See Table F.3.2 for recommendations regarding the residual adverse or uncertain effects identified.

F.2.5 Policy GT(LPR6) – 1 Oak Lodge, Tilden Lane, Marden

F.2.5.1 Policy GT(LPR6) sets out details for the allocation of Site 0177 as assessed in the SA process. The full assessment of the site, alongside other reasonable alternatives, can be found in Appendix C (pre-mitigation) and Appendix E (post-mitigation).

F.2.5.2 The following assessment considers the extent to which the provisions of Policy GT(LPR6) will further improve sustainability of the site.

Policy GT(LPR6) – 1 Oak Lodge, Tilden Lane, Marden

In accordance with policy TR4, planning permission for two permanent pitches at 1 Oak Lodge, Tilden Lane, Marden, as shown on the Policies Map, will be granted if the following criteria are met:

  1. The total capacity of the site does not exceed two gypsy and traveller pitches.
  2. The substantial landscape buffer to the north west and west of the site is retained and maintained.

F.2.5.3 Policy GT(LPR6) sets out the requirement for the existing landscape buffer to the west of the site to be retained and ensures the capacity of the site remains capped at two pitches. The policy will be likely to ensure that the GTTS development remains screened, limiting visual intrusion into the wider landscape. These provisions are, however, unlikely to further enhance the site's sustainability performance beyond what was identified in the post- mitigation assessment. Accordingly, the assessment of the policy against the SA Objectives remains unchanged from that presented for Site 0177 in Appendix E.

F.2.5.4 It is recommended that Policy GT(LPR6) requires a site-specific Flood Risk Assessment to be submitted with any planning application, given the site's location wholly within Flood Zone 2. The allocation should also be supported by evidence that the Sequential Test has been applied and, if necessary, the Exception Test, to ensure that GTTS development at this location would be safe and appropriate. See TableF.3.2for further recommendations regarding the residual adverse or uncertain effects identified.

F.2.6 Policy GT(LPR7) – The Paddocks, George Street, Staplehurst

F.2.6.1 Policy GT(LPR7) sets out details for the allocation of Site 0081 as assessed in the SA process. The full assessment of the site, alongside other reasonable alternatives, can be found in Appendix C (pre-mitigation) and Appendix E (post-mitigation).

F.2.6.2 The following assessment considers the extent to which the provisions of Policy GT(LPR7) will further improve sustainability of the site.

Policy GT(LPR7) – The Paddocks, George Street, Staplehurst

In accordance with policy TR4, planning permission for two permanent pitches at The Paddocks, George Street, Staplehurst, as shown on the Policies Map, will be granted if the following criteria are met:

  1. The total capacity of the site does not exceed four gypsy and traveller pitches.
     
  2. Access to the site is via the existing access off George Street.
     
  3. The additional pitches are sited within the site boundaries as defined on the Policies Map.
     
  4. A landscaping scheme for the site is approved which provides for:
    1. The retention and future maintenance of the trees and hedge line along the site’s frontage to George Street; and
       
    2. The establishment of a native species landscaped boundary along the rear (northern) edge of the site to create a more permanent boundary.
       
  5. An ecological assessment of the site is undertaken and the proposals incorporate necessary habitat creation, enhancement and mitigation measures.

F.2.6.3 Policy GT(LPR7) sets out the requirements for a landscaping scheme and ecological assessment to inform the proposed development, that ensures trees and hedges alongside the site boundaries are maintained and enhanced including a stronger boundary to the north of the site. These measures will be likely to help minimise intrusion on the landscape, and help to conserve the character and appearance of the site and its surroundings. There is potential for a minor positive impact on the landscape (SA Objective 13).

F.2.6.4 The proposed landscaped boundary to be established, including planting of native species, accompanied by ecological assessments as required under the policy, will be likely to identify and secure opportunities for new habitat creation. There is potential for positive effects on biodiversity at the local level; however, in absence of the HRA conclusions the overall impact for SA Objective 11 remains uncertain, owing to potential for development at this site to contribute to cumulative adverse effects associated with air quality, water quality/quantity and recreation at European sites.

F.2.6.5 For the remaining SA Objectives, the policy's provisions are unlikely to further enhance the site's sustainability performance beyond what was identified in the post-mitigation assessment. Accordingly, the assessment of the policy against the other SA Objectives remains unchanged from that presented for Site 0081 in Appendix E.

F.2.7 Policy GT(LPR9) – Flips Hole, South Street Road, Stockbury

F.2.7.1 Policy GT(LPR9) sets out details for the allocation of Site 0106 as assessed in the SA process. The full assessment of the site, alongside other reasonable alternatives, can be found in Appendix C (pre-mitigation) and Appendix E (post-mitigation).

F.2.7.2 The following assessment considers the extent to which the provisions of Policy GT(LPR9) will further improve sustainability of the site.

Policy GT(LPR9) – Flips Hole, South Street Road, Stockbury

In accordance with policy TR4, planning permission for five permanent pitches at Flips Hole, South Street Road, Stockbury, as shown on the Policies Map, will be granted if the following criteria are met:

F.2.7.3 Policy GT(LPR9) sets out the requirements for a landscaping scheme to be prepared that ensures the existing landscaped boundaries of the site are maintained. These measures will be likely to help minimise intrusion on the landscape and help to conserve the character and appearance of the site and its surroundings. However, given the site's location within the Kent Downs National Landscape, a minor negative impact on the special qualities and character of the landscape cannot be ruled out (SA Objective 13). It is recommended that Policy GT(LPR9) requires a site-specific landscape assessment (such as a Landscape and Visual Appraisal) to inform the site layout and design to ensure that any potential adverse effects can be avoided or suitably mitigated.

F.2.7.4 For the remaining SA Objectives, the policy's provisions are unlikely to further enhance the site's sustainability performance beyond what was identified in the post-mitigation assessment. Accordingly, the assessment of the policy against the other SA Objectives remains unchanged from that presented for Site 0106 in Appendix E.

F.2.8 Policy GT(LPR10) – The Ash, Yelsted Road, Stockbury

F.2.8.1 Policy GT(LPR10) sets out details for the allocation of Site LPRGT1(10) as assessed in the SA process. The full assessment of the site, alongside other reasonable alternatives, can be found in Appendix C (pre-mitigation) and Appendix E (post-mitigation).

F.2.8.2 The following assessment considers the extent to which the provisions of Policy GT(LPR10) will further improve sustainability of the site.

Policy GT(LPR10) – The Ash, Yelsted Road, Stockbury

F.2.8.3 Policy GT(LPR10) sets out the requirements for a landscaping scheme to be prepared that ensures the existing landscaped boundaries of the site are maintained. These measures will be likely to help minimise intrusion on the landscape and help to conserve the character and appearance of the site and its surroundings. However, given the site's location within the Kent Downs National Landscape, a minor negative impact on the special qualities and character of the landscape cannot be ruled out (SA Objective 13).

F.2.8.4 These provisions are unlikely to further enhance the site's sustainability performance beyond what was identified in the post-mitigation assessment. Accordingly, the assessment of the policy against the SA Objectives remains unchanged from that presented for Site LPRGT1(10) in Appendix E.

F.2.9 Policy LPR(022) – Land rear of Chart View – Site A

F.2.9.1 Policy LPR(022) sets out details for the allocation of Site LPR022 as assessed in the SA process. The full assessment of the site, alongside other reasonable alternatives, can be found in Appendix C (pre-mitigation) and Appendix E (post-mitigation).

F.2.9.2 The following assessment considers the extent to which the provisions of Policy LPR(022) will further improve sustainability of the site.

Policy LPR(022) – Land rear of Chart View – Site A

In accordance with policy TR4, planning permission for two permanent pitches at Land rear of Chart View – site A as shown on the Policies Map, will be granted if the following criteria are met:

  1. The site is accessed via the existing track off Chart Hill Road.
     
  2. The proposed pitches are suitably located within the site, taking account of any site specific constraints (to be identified prior to Regulation 19).
     
  3. A landscaping scheme for the site is approved which provides for the retention and future maintenance of any hedgerows present and/or the establishment of a suitable native species landscaped boundary.
     
  4. A phase 1 habitat survey is undertaken, which may as a result require on and/or off-site mitigation for the existing habitat of local fauna/flora.

These measures will be likely to help minimise intrusion on the landscape and help to conserve the character and appearance of the site and its surroundings. There is potential for a minor positive impact on the landscape (SA Objective 13).

F.2.9.4 The proposed landscaped boundary to be established, including planting of native species, accompanied by an ecological survey as required under the policy, will be likely to identify and secure opportunities for new habitat creation. There is potential for positive effects on biodiversity at the local level; however, in absence of the HRA conclusions the overall impact for SA Objective 11 remains uncertain owing to potential for development at this site to contribute to cumulative adverse effects associated with air quality, water quality/quantity and recreation at European sites.

F.2.9.5 For the remaining SA Objectives, the policy's provisions are unlikely to further enhance the site's sustainability performance beyond what was identified in the post-mitigation assessment. Accordingly, the assessment of the policy against the other SA Objectives remains unchanged from that presented for Site LPR022 in Appendix E.

F.2.10 Policy LPR(023) – Land rear of Chart View – Site B

Policy LPR(023) – Land rear of Chart View – Site B

In accordance with policy TR4, planning permission for two permanent pitches at Land rear of Chart View – site B as shown on the Policies Map, will be granted if the following criteria are met:

F.3.2 Recommendations

F.3.2.1 The site allocation policies prepared by MBC reflect the current available evidence at the Regulation 18c stage of plan making. Evidence gathering and stakeholder engagement are ongoing with the DPD consultation document yet to finalised, and as such there is potential for the policies to be updated at the next (Regulation 19) stage. Any new or revised policies will be assessed within the Regulation 19 SA Report accompanying the next stage.

F.3.2.2 Based on the policy wording and assessments carried out to date, Table F.3.2 sets out a range of recommendations for MBC to consider in order to improve the sustainability performance of the site allocation policies as the DPD preparation continues for SA Objectives where adverse effects have been identified (see Table F.3.1).

  • MBC should ensure, where possible, that the proposed sites seek to provide access to local services, healthcare, recreational facilities and schools to facilitate sustainable development and integration with the non-traveller community. In the first instance, well-connected sites should be prioritised. The development of travel plans should also be considered to improve public transport connections and also through extending footpaths to connect with nearby settlements.

SA6: Natural Resources

  • Development on previously undeveloped land of ALC Grade 1, 2 or 3a should be avoided. Where this is not possible, developers should refer to DEFRA best practice guidance1.
     
  • It is recommended that more detailed soil surveys are carried out to determine the presence of ALC Grade 3a and 3b land. Soil surveys help to determine the impact of development on soil health, ecosystem services and natural capital. Further soil surveys will help to inform site layouts and the retention of higher-grade soils for community sue, such as allotments that will help maintain soil productivity.

SA7: Water

  • Undertaking a water cycle study, or liaising directly with water companies, is recommended to allow a more thorough evaluation of the impact of the GTTS DPD alongside other planned growth in Maidstone and neighbouring authorities in regard to water resources and water quality.
     
  • It is recommended that in line with Environment Agency advice, the site allocation policies (or wider DPD policies) should ensure that every effort is made to connect new pitches to the mains sewer network, to reduce risks to groundwater quality associated with non-mains drainage solutions.

SA9: Flooding

  • Caravans and mobile homes are considered highly vulnerable to flooding. MBC should ensure a Strategic Flood Risk Assessment (SFRA) is carried out for the area, using the latest Flood Map for Planning and considering all sources of flood risk. Site-specific Flood Risk Assessments may be required for sites that lie within wholly or partially in Flood Zone 2 (Policy GT(LPR6) – Site 0177; Policy C4S(002) – Site C4S-002; and Policy C4S(015) – Site C4S-015). These assessments should inform the selection of appropriate sites and layout of pitches/plots within sites, ensuring that the Sequential Test is applied and the Exception Test is used where necessary.

SA11: Biodiversity

  • The findings and recommendations of the HRA process should be embedded into the DPD policies where relevant to ensure that GTTS development will secure any necessary mitigation to protect the integrity of European sites from adverse effects as a result of the DPD alone or in-combination with other plans and programmes.
     
  • The emerging outputs of the Kent and Medway Local Nature Recovery Strategy2 should be taken into account to ensure that growth contributes to, and does not detract from, ecological networks and biodiversity. Development should generally be avoided in 'Areas of Particular Importance for Biodiversity' (APIB), and where development sites overlap with 'Areas that Could become of particular Importance for Biodiversity' (ACIB), opportunities should be explored for ecological enhancements that can restore nature and connections between habitats. This would be especially important for sites adjacent or in close proximity to ancient woodland (Policy C4S(003) – Site C4S-003; and Policy C4S(019) – Site C4S-019) or coincident with priority habitats (Policy C4S(001) – Site C4S-001; and Policy LPR(256) – Site LPR256).
     
  • It is recommended that new development follows the principles and standards as set out in Natural England's Green Infrastructure Framework to ensure effective green and blue infrastructure can be delivered and maintained alongside growth.
     
  • Where various site policies refer to the need to carry out Phase 1 Habitat Surveys, it is recommended that this should instead refer to Preliminary Ecological Appraisal (PEA), followed by Ecological Impact Assessment (EcIA) where necessary to inform any required mitigation.

SA13: Landscape

  • It is recommended that where development has potential to affect the Kent Downs National Landscape or its setting, especially sites within the National Landscape (Policy GT(LPR9) – Site 0106; and Policy LPR(256) – Site LPR256), the site allocation policies should include stronger reference to the need to conserve and enhance the special qualities and character of the National Landscape. Site-specific landscape assessments (such as a Landscape and Visual Appraisal) may be necessary to inform the site layout and design to ensure that any potential adverse effects can be avoided or suitably mitigated.
