We are concerned that in respect of ensuring impacts to the KDNL are mitigated, the SPD does not really provide any more detail/guidance than what is already set out in Local Plan policy LPRSP4(B) and in some matters, it provides a lower level of detail than is included in the policy. As such, we do not consider MBC are in compliance with their new statutory duty under S85 of the CRoW Act 2000.
Objection noted.
The SPD provides sufficient guidance in the context of policy LPRSP4(B) regarding the employment area and the guidelines will be read alongside that policy and the wider policies of the LPR and elsewhere in the SPD. This includes detail on a range of matters including lighting and structural planting.
Modifications have been made to the SPD in response to comments made via the previous consultation in respect of the relationship with the Kent Downs National Landscape to provide further clarity regarding how impacts should be mitigated.
Officers consider that collectively the SPD provides an appropriate level of guidance to inform decision making and appropriately protects the purpose of conserving and enhancing the natural beauty of the KDNL in accordance with the CRoW Act 2000.

We request additional certainty and clarification in connection with ensuring mitigation to the KDNL, in respect of lighting, materiality, siting of buildings and structural landscaping.
